Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the IDWIW application and website (collectively, the “Service”) operated by Tabi Palette Inc. (“Company,” “we,” “us,” or “our”), a company incorporated in Nishinomiya, Hyogo, Japan. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Accounts & Eligibility

To use the Service, you must sign in with a Google account (“Google OAuth”). We do not support other authentication methods at this time.

You must be at least 13 years of age to create an account. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have parental or guardian consent to use the Service.

You are responsible for maintaining the security of your Google account and for all activity that occurs through your use of the Service. You must notify us promptly if you suspect unauthorized access.

2. Description of Services

IDWIW (“I Decide What I Watch”) is a YouTube viewing client that provides an intentional, distraction-free interface for consuming YouTube content. The Service displays YouTube videos via iframe embedding and offers features including:

  • A chronological subscription feed
  • A personal watch queue
  • A distraction-free video player (no comments, no sidebar recommendations)
  • AI-powered video overviews

The Service is offered in two tiers:

  • Free: Core features with limited channel subscriptions (up to 20) and limited AI Overview actions (30 per month).
  • Pro ($3/month): Unlimited channels, unlimited AI Overview actions, priority flags, history search, and additional features as they become available.

IDWIW does not host video content. All video content is provided by YouTube and is subject to YouTube’s own Terms of Service.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.

You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use the Service to build a competing product or service
  • Sublicense, resell, or redistribute access to the Service

Your use of the Service must also comply with the YouTube Terms of Service and the YouTube API Services Terms of Service.

4. Subscription, Fees & Payment

The Free tier is available at no cost. The Pro tier requires a paid monthly subscription.

All payments are processed through Stripe. By subscribing to the Pro tier, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

  • Auto-renewal: Your Pro subscription will automatically renew each month unless you cancel before the next billing cycle.
  • Cancellation: You may cancel your Pro subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.
  • Price changes: We may change subscription pricing with at least 30 days’ notice. Continued use after a price change constitutes acceptance of the new price.

All fees are stated in USD unless otherwise indicated.

5. User Content & Intellectual Property

IDWIW does not host user-generated video content. The Service stores your preferences, watch queue, and viewing history to provide its core functionality.

You retain ownership of any data you provide (e.g., queue selections, priority flags). By using the Service, you grant us a limited license to use this data solely to operate and improve the Service.

All intellectual property in the Service—including its design, code, branding, and AI features—is owned by Tabi Palette Inc. or its licensors and is protected by applicable intellectual property laws.

6. Acceptable Use

You agree not to:

  • Scrape, crawl, or use automated tools to extract data from the Service
  • Circumvent usage limits, rate limits, or access controls
  • Share your account credentials or allow others to access your account
  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems

We reserve the right to suspend or terminate your access if you violate these restrictions.

7. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Termination

You may stop using the Service and delete your account at any time through your account settings.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, suspected fraudulent activity, or extended periods of inactivity.

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account data, including your queue and preferences
  • Any outstanding fees remain payable
  • Provisions that by their nature should survive termination will survive (including Disclaimers, Limitation of Liability, and Indemnification)

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • YouTube content will remain available through the Service (YouTube may change its API or terms at any time)
  • AI-generated overviews or summaries will be accurate, complete, or reliable—they are provided for informational purposes only and should not be relied upon as a substitute for watching the actual video content

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, war, terrorism, power outages, internet disruptions, or changes to third-party services (including YouTube API changes).

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TABI PALETTE INC., ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tabi Palette Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including YouTube’s Terms of Service

13. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days’ notice via the Service or by email before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Japan.
